LAKE HAVASU CITY PROPERTIES ON REAL ESTATE
Septic Transfer FEE.
Home
sellers something you should know if you are selling your home. In
accordance with Arizona Administrative Code, Title 18, Chapter 9,
Article 3, Mohave County Department of Public Health requires that
septic systems which are sold with properties must be transferred into
the new owner’s name and a transfer fee must be paid.
The
purpose of the transfer is for the following two reasons according to
the Mohave County Department of Public Health: (1) a septic permit is a
permit to discharge. If the new owner moves onto the property and the
permit is not in their name they are discharging wastewater without a
permit and are in violation of Environmental Laws. (2) Septic systems
are possible environmental hazards/nuisances; it is imperative that the
county records are maintained and are up to date.
The
transfers must take place in accordance with Arizona Law. The transfers
are mandatory and not voluntary and cannot be waived. Should the
transfer not take place at the time of sale, the property owner, and
anyone involved in the transfer of the property could be held liable by
Mohave County and subject to both civil and criminal penalties.
The
transfer fee is $50 for septic systems constructed prior to January 1,
2001 and $75 for septic systems constructed after January 1, 2001.
